How long do Personal Injury claims take?

Dedicated Personal Injury LawyersUnfortunately, no-one can guarantee that you will win your Personal Injury claim.  Claims can take different times; generally:

 

  • A claim involving a road traffic accident might take 3 to 6 months
  • A claim involving an accident at work or in a public place might take 6 to 18 months
  • A holiday illness claim might take 12 to 18 months

 

However, claims can take longer or they can be quicker – it really depends on the following things:

 

  • The type of claim (see above)
  • How quickly your lawyers deal with your case
  • How quickly the Defendant responds and whether they respond in time
  • Whether the Defendant admits or denies liability (responsibility) for your case
  • How quickly your GP or hospital records are sent to your lawyer
  • How quickly an independent medical expert can see you and prepare a report
  • How quickly or whether you recover from your injuries
  • How many independent medical experts you need to see
  • The timeframes determined by the type of claim and the legal procedures it must be run under (for example, running a case on the “Portal” (an online system for cases) is quicker than sending a traditional “Letter of Claim” to notify the Defendant)
  • Whether the lawyer needs to involve the Court
  • The timeframes determined by the Court and how quickly the Court deals with your case
